An opinion piece on Forbes raises some interesting questions about the future of divorce in the country. Normally questions of marriage and divorce have been left up to the states, not to the federal government. However, there have been times when the federal government has stepped in to set guidelines that all states must follow. The recent ruling on same-sex marriage is one of these, though there have been others previous to that.
Should the same thing be done with states as well? The divorce rules between states or even different counties can differ quite widely. Often the opinions of a judge play a major role in the final settlement, since many locations do not have formal guidelines for all aspects of divorce. Spousal maintenance rules between states, as the article shows, can have wide differences.
We will set aside the question of whether or not there should be national guidelines for divorce rulings. Instead, we urge anyone considering a divorce to do research into the local and state laws themselves, or talk with a family law lawyer about their questions regarding divorce. Divorce can be as big of a step as marriage. Don’t enter into it lightly and know what you’re getting into before you start the process.
