Same Sex Divorces Now Legal

Texas Judge Grants Same-Sex Divorce after Long Fight

By now you probably know that same-sex marriage is now legal in all 50 states thanks to a historic Supreme Court decision. Yet some gay couples are breathing a sigh of relief for another reason. The legalization of same-sex marriage has also made it legal for same-sex couples to divorce.

A few couples, notably in Florida, have publicly been fighting for the right to divorce before the ruling. Now an uptick will start to slowly grow. About 10 years from now, according to one lawyer, the rate of same-sex marriage divorces per year will see an uptick.

Marriage isn’t something to rush into. Marriage does give the couples a lot of benefits, but it also exposes them to legal dangers as well. A divorce brings up questions of spousal support, child support, custody right, and how to split assets and debts. Before you tie the knot, you should consider how you would handle these questions with your partner in the event it ever does happen. You might even consider signing a pre-nuptial agreement.

If you’re in a same-sex partnership and you wish to seek divorce, or you are curious about how to write a legally-binding pre-nuptial agreement, you’ll need the help of a family law lawyer. The lawyers at Elise Buie Family Law Group, PLLC can help if you live in the state of Washington. Call our office today for a confidential consultation.
